My company wants me to relocate to another state. Because of which I need to re apply for new LC for green card processing. My current approved LC is EB3. My question: To be able to apply for EB2 position, can I use training & experience gained in my current company?

I am planning to apply for Schengen visa in an Italian consulate. I have an expired H1 but a valid AP. According to the italian consulate website, here is one of the visa requirements
"passport or travel document valid for at least three months after visa expiry date"
My passport is expiring in 2 years but my AP will be expiring in about 2 1/2 months from the Schengen visa expiry. Will I have an issue getting a visa ?
Do I have a workaround ?

I was laid off by my employer( Big staffing company) and i am in the 2 weeks notice period . I am looking for any company( desi one - reasonable) who can sponsor my H1B and also start the GC process immediately .They should be able to work with most of the vendor ( corp-corp)
I am in my end of 6 th year and my employer is willing to give the approved 1 140 ( Eb2- Feb 2006 PD ) .
what are my best options right now .I am looking for some advise about good company with decent track record ?
I had pretty bad experience earlier with a chicago based desi company and then moved this big staffing firm . I am not looking for great marketing as i can manage myself.

I have an opportunity to do some consulting work for a company B on a part-time basis apart from my current full time job with company A. I know that I will need another H1 for the part time gig but what I am confused about is whether the company B has to wait for next years quota to file for an H1 or can it file immediately ? Meaning is the H1b quota tied to max no of individuals ? or to max no of positions ?
I would appreciate if some one knowledgeable about the issue can comment on my question:confused:

1. your employer has to proffer you a position which has either BS+5 or advanced degree as minimum requirement.
2. you accept it and ask your employer to start the GC process.
3. your employer applies for Labor Certification for the proffered position.
4. your employer applies for 140 for the cleared labor. here the employer requests the USCIS to use the earlier PD of your approved EB3 140

having valid AP at any time, even though is not a legal requirement, is a necessity due to potential emergency travel to home country or any other country. Hence it is safe to reapply AP 2-3 months before expiry and EAD 3-4 months before expiry. This will give you peace of mind.

1. You can definitely change the employer and invoke AC21. No issues there..
2. You can change AOS to consular, but not after you've invoked AC21.
Actually there's probably a way to do that too , but maybe a good (and probably expensive) lawyer needs to be consulted.

My H1-B is expiring in December 2007. I have approved I-140 now and am hoping to get 3 year H1-B extension based on my approved I-140. Do you think I can get 3 year extension even if the visa numbers for filing AOS is current? Does AC21 apply to this case? Please suggest.
well if it is current you wont get it for 3 years, however I know AOS is unavailable, you if you apply before OCT you should be fine. once visa bulletin for OCT come out if you become current then if you file for 3 year, you will only get for 1 year

My EB1 is not a very strong case as it is, so we are relying on the EB3 petition. I will definitely correct my profile as suggested.
No disrespect intended, I still am not sure after reading your post whether one can take a employer sanctioned long leave of absence for a genuine reason in this case( child care).
